Terms of Service

1. Agreement

By using any XFlash product, you agree to these terms. If you don't agree, don't use the service.

2. The service

XFlash provides SaaS products (currently SmartRestro, with Gymnexa and SchoolBase in development). Features may change as we improve them; we'll give 30 days notice before removing anything material.

3. Your account

You're responsible for your account credentials and all activity under your account. Notify us immediately at [email protected] if you suspect unauthorized access.

4. Acceptable use

Don't use our products to:

  • Break any law (local or international)
  • Send spam, phishing, or fraudulent messages
  • Sell prohibited goods (illegal drugs, weapons, etc.)
  • Resell our service to others without our written permission
  • Attempt to reverse-engineer, scrape, or DDoS the service

Violation means immediate suspension. No refund for the unused period.

5. Payment + billing

  • Subscription is billed monthly in advance.
  • 14-day free trial available on first signup, no credit card needed.
  • You can cancel anytime — access continues until the end of the paid period.
  • No partial refunds for unused days, except in specific cases (we'll evaluate case-by-case).
  • Prices may increase with 30 days notice. Your existing billing cycle is honored at the old rate.

6. Your content

Anything you upload (menu photos, restaurant name, customer data) remains yours. You grant us a non-exclusive license to host and process it on your behalf, solely to provide the service.

7. Our intellectual property

Our software, design, branding, and documentation are owned by XFlash. You get a non-transferable, non-exclusive license to use them during your subscription. You don't own the code or platform.

8. Custom domains

If you point your domain at us, you authorize us to issue SSL certificates on your behalf (via Let's Encrypt). You're responsible for keeping your domain DNS pointing at our servers.

9. Uptime + SLA

We target 99.5% monthly uptime. Planned maintenance windows (announced 48 hours in advance, typically Sundays 3–5 AM PKT) don't count against this. If we fall below 99.5% in a month, you get a pro-rata service credit on your next invoice.

10. Liability

The service is provided "as is". We're liable for our gross negligence or willful misconduct, capped at 12 months of subscription fees you've paid us. We're not liable for indirect or consequential damages.

11. Termination

You can cancel anytime from the dashboard. We can terminate your account for material breach (acceptable-use violations, non-payment over 30 days, etc.) after giving 14 days notice to cure.

12. Governing law

These terms are governed by Pakistani law. Disputes go to courts in Karachi, Pakistan. Both parties waive jury trial where applicable.

13. Changes

We may update these terms. Material changes are emailed to active users 30 days before they take effect. Continued use after the effective date means acceptance.
